Former Supreme Court Justice Krishna Iyer had propounded a principle that it is the fundamental right of every poor to get free legal aid.
Advocate Kalika Prasad Kala 'Manas' said that the poor get free lawyers not only for fighting criminal cases, but also for fighting civil cases. According to him, if a poor person is fighting a civil case, then there is a provision of 'pauper's suit' in the Civil Procedure Code. The courts have got this power that they can provide an amicus curiae ie 'amicus curie' to a poor person at government expense to fight the case. However, in civil matters, the tradition of giving amicus curiae to poor people at government expense is rarely seen.
Who gets free legal aid
Advocate Kalika Prasad Kala said that the Indian Parliament had passed the Legal Services Authorities Act in the year 1987 to provide free legal aid to the poor. According to Advocate Kala, the people who are given free legal aid are as follows...
1. People belonging to Scheduled Caste or Scheduled Tribe community.
2. Beggars or victims of human trafficking.
3. To women, children and disabled.
4. To the victims of any natural calamity like earthquake, flood and drought etc.
5. To a person who is a victim of riot or caste violence or communal violence.
6. To the victims and workers of any industrial accident.
7. Juveniles and mental patients of Child Improvement Home.
8. To such a person whose annual income is less than 25 thousand.
